October 28 was the date the final HOS regulations were to released. It came and went… and no final regs. It was not a surprise.
At the ATA Safety Conference last month, a FMCSA representative indicated that the regulations would not be release until late November. Transport Topics recently reported that there is an agreement among the parties to the lawsuit permitting the delay. There is to be a status report to the Court on November 28, 2011.
The bad news is that there is continuing uncertainty as the time parameters facing our industry. The good news is that regretable regulations complicating compliance and enforcement and reducing available hours has not been imposed.
